Please read these terms carefully. By creating an account or using BarberPlace, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.
1. Acceptance of Terms
By accessing or using BarberPlace operated by BarberPlace ("we", "us", "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all terms, you may not use the platform.
2. Description of Service
BarberPlace is a platform that connects freelance barbers with salons seeking their services. The platform allows:
- Barbers to create profiles, set availability, and be discovered by salons
- Salons to search for available barbers based on dates and location
- Direct messaging between barbers and salons
- Admins to manage the platform and post offers/promotions to salons
โ ๏ธ Important: BarberPlace is a marketplace platform only. We do not employ barbers, and we are not a party to any agreement made between barbers and salons through the platform. Any arrangements, agreements, or disputes are solely between the barber and salon involved.
3. User Accounts
3.1 Account Types
๐ Barber Accounts
For individual freelance barbers seeking work opportunities with salons
๐ช Salon Accounts
For salon businesses seeking barbers. Requires admin approval before access is granted.
โ๏ธ Admin Accounts
For platform management. Require mandatory two-factor authentication at all times.
3.2 Registration Requirements
- You must provide accurate, complete, and truthful information when registering
- You must be at least 18 years old to use the platform
- You must verify your email address to activate your account (email registration only)
- Salons must complete business verification and receive admin approval before accessing the platform
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorised account access at privacy@barberplace.co.uk
- You may only hold one account per person or business
3.2a Third-Party Sign-In (Google)
You may register and sign in using your Google account. When you do:
- We receive your name and email address from Google โ no passwords are stored by BarberPlace
- If you sign in with the same email address as an existing account, you will be logged into that account
- Salon accounts registered via Google still require admin approval before platform access is granted
- Your use of Google sign-in is also subject to Google's Terms of Service
3.3 Account Suspension and Termination
We reserve the right to suspend or terminate accounts that:
- Provide false or misleading information
- Violate any of these Terms of Service
- Engage in abusive, fraudulent, or harmful behaviour toward other users
- Remain inactive for more than 12 months without notice
- Are found to be involved in criminal activity
You may close your account at any time via the Settings page. Upon requesting deletion:
your account is immediately deactivated and will be
permanently deleted after a 7-day grace period. You will receive
a confirmation email with a link to cancel the deletion if you change your mind.
After 7 days, all personal data is permanently erased in accordance with our Privacy Policy.
Audit logs are retained for 6 years as required by law.
4. User Obligations
By using BarberPlace, you agree to:
- Provide truthful and accurate information in your profile and all communications
- Use the platform only for its intended lawful purpose of connecting barbers and salons
- Treat all other users with respect and professionalism
- Not post false reviews, misleading information, or unsolicited commercial messages
- Not attempt to circumvent or undermine platform security measures
- Not use the platform to harass, threaten, stalk, or discriminate against others
- Not copy, scrape, or redistribute platform content without our written permission
- Not use automated tools, bots, or scripts to access the platform
- Comply with all applicable UK laws including employment law, tax obligations, and data protection law
5. Salon-Specific Terms
- Salons must provide accurate and verifiable business information during registration
- Approval to access the platform is at our sole discretion and may be refused or revoked without explanation
- Approved salons are solely responsible for verifying barbers' qualifications, identity, and right to work in the UK
- Salons must not share their login credentials with third parties
- Salons are responsible for any agreements, contracts, or payments made with barbers found through the platform
- BarberPlace is not responsible for the quality, safety, or outcome of services provided by barbers discovered through the platform
6. Barber-Specific Terms
- Barbers are independent contractors and are not employees of BarberPlace or any salon
- Barbers are solely responsible for their own tax compliance, National Insurance, professional insurance, and qualifications
- Barbers must accurately represent their skills, experience, and availability
- Barbers are responsible for negotiating, agreeing, and fulfilling their own terms with salons
- BarberPlace is not responsible for any disputes regarding pay, working conditions, or the quality of work
- Barbers must ensure their profile photos and portfolio images do not infringe third-party rights
7. Messaging and Conduct
7.1 Permitted Use
The BarberPlace messaging system is provided solely to facilitate professional communication between barbers and salons regarding work opportunities. All messages must be professional, relevant, and respectful.
7.2 Prohibited Conduct
You must not use the messaging system to send:
- Harassing, threatening, or abusive messages
- Discriminatory content on the basis of race, gender, age, disability, religion, sexual orientation, or any other protected characteristic under the Equality Act 2010
- Spam, unsolicited advertising, or promotional content unrelated to work opportunities
- Content that is obscene, offensive, or otherwise inappropriate
- Personal contact details for the purpose of circumventing the platform
- Any content that is unlawful or that facilitates illegal activity
7.3 Reporting
Users may report messages they believe violate these Terms using the report function within the messaging interface. Reports are reviewed by our team. You will not be notified if a report is made against you, but we may take action on your account if a report is upheld.
7.4 Message Storage and Review
Messages are stored on our servers for a minimum of 12 months. In response to a valid report, our team may review the content of messages in the reported conversation. In response to a lawful request from law enforcement, we may disclose message content as required by law. By using the messaging system, you consent to this.
7.5 Our Rights
We reserve the right to remove messages, suspend messaging privileges, or terminate accounts where we determine, in our sole discretion, that these conduct standards have been violated. We are not obligated to monitor messages proactively but will act on reports made to us.
8. Offers and Promotions
- Offers posted by admins are for information purposes only and do not constitute a binding contract
- Expressing interest in an offer is not a commitment to purchase
- We are not responsible for the accuracy of third-party product or service information in offers
- Any transactions arising from offers are solely between the salon and the relevant supplier
- We reserve the right to remove any offer at any time without notice
8. Intellectual Property
- The BarberPlace name, logo, and platform design are owned by BarberPlace
- User-generated content (profiles, photos, messages) remains owned by the user who created it
- By uploading content, you grant BarberPlace a non-exclusive licence to display it on the platform for the purpose of providing the service
- You must not upload content that infringes third-party intellectual property rights
- You must not reproduce, copy, or distribute any part of the platform without our written permission
9. Privacy
Your use of the platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to our data practices as described in the Privacy Policy.
10. Disclaimers and Limitation of Liability
BarberPlace is provided "as is" without warranties of any kind. To the maximum extent permitted by applicable law:
- BarberPlace is not liable for any agreements, disputes, or transactions between barbers and salons
- We do not guarantee the accuracy, completeness, or quality of user profiles
- We are not responsible for any loss of earnings, business opportunity, or revenue arising from use of the platform
- We are not responsible for platform downtime, data loss, or technical failures beyond our reasonable control
- Our total liability to you shall not exceed the amount you have paid us in the 12 months preceding the claim
Nothing in these terms limits our liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable UK law.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to Terms
We may update these Terms from time to time to reflect changes in the law, our services, or business practices. We will notify registered users of material changes by email at least 14 days before they take effect. The "Last updated" date at the top of this page indicates when the Terms were last revised.
Continued use of the platform after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the platform and may close your account.
